EB-2
National Interest Waiver.

You focus on refining your skills. We will handle your immigration.

We Are Your Biggest Fans.

Most of our clients were too humble to pre-qualify themselves to be of national importance.

Most of our clients were too humble to pre-qualify themselves as people of national importance. The EB-2 is an immigrant petition that puts you on the path to a green card. It's for individuals who hold an advanced degree (or five years of relevant work experience), or who have exceptional ability in the sciences, arts, or business.
Normally, EB-2 requires a job offer and labor certification (PERM). With a National Interest Waiver, you may skip both — if you can show that your work is in the national interest of the United States. That waiver is what lets you self-petition.

EB-2 Visa Advantages

The U.S. government is generally welcoming to highly skilled professionals.

#AmericanDream.

Short Backlog

The priority date is usually current, meaning little to no backlog in this category.

Path to Citizenship

An approved EB-2 puts you on the path to a green card, and eventually U.S. citizenship.

Self-Sponsor

With a National Interest Waiver, you may petition for yourself — no employer sponsor required.

No PERM with NIW

The National Interest Waiver lets you skip PERM, the lengthy process of testing the labor market for qualified U.S. workers.

Flexible Degree

You need an advanced degree or its equivalent, or five years of relevant work experience.

Build On Your H1-B

An approved EB-2 petition can support H-1B extensions beyond the usual six-year limit.

Criteria

There are a few criteria that go into preparing your Petition.

If you hold an advanced degree, such as a Master's or its equivalent, or a Bachelor's degree plus at least five years' experience, you meet the criteria and qualify. If not, don't worry; there's another way. You'll need to meet 3 of the 7 categories below to show exceptional ability.
Our attorneys make sure all your documents and evidence are submitted according to the regulations and deadlines.

EB-2 Criteria for Exceptional Ability Individuals in Arts, Business, Sciences

You only need to meet 3 out of the 6 criteria.

Official Academic Record

If you have an official academic record from a learning institution relating to your area of exceptional ability, then you meet this criterion.

10 Years of Experience

If you have letters documenting at least ten years of full-time experience in your occupation, then you meet this criterion.

License to Practice

If you have a license to practice your profession or certification for your profession or occupation, then you meet this criterion.

High Income

If you have a significantly high salary demonstrating your exceptional ability, then you meet this criterion.

Membership

If you have membership in a professional association with a distinguished reputation, then you meet this criterion.

Recognition of Achievements

If you've been recognized for your achievements and significant contributions to your industry or field by peers, government entities, or professional and business organizations, then you meet this criterion.

Comparable Evidence

If you have any other proof of your extraordinary ability, then you submit under this criterion.

Criteria

There are a few criteria that go into preparing your NIW Petition.

The EB-2 with a National Interest Waiver lets you skip the lengthy PERM process and self-petition. To qualify, you must show that your work is in the national interest by meeting the three criteria below.

NIW

You must meet all criteria.

National Merit & Importance

The proposed endeavor has both substantial merit and national importance.

Advance Endeavor

You are well-positioned to advance the proposed endeavor.

Beneficial to the U.S.

It would be beneficial to the United States to waive the requirements of a job offer, and thus the labor certification.

Dreamers & Doers.

Whom we recommend this for.

We recommend the EB-2 NIW for talented people with advanced degrees or exceptional ability who want to build their future in the U.S. It can become your permanent home, and after five years as a green-card holder you may apply for U.S. citizenship.
