E-2 allows foreign investors to work in the U.S. This visa class is exclusively for what the USCIS terms “treaty traders and investors.” This means that all applicants must be nationals of a country that holds a treaty of trade and commerce with the United States.

Valid for up to 3 years and renewable with no maximum stay.

Criteria

There are a few criteria that go into preparing your visa.

If you already have a qualifying business, you're set. If you're coming to the U.S. to set up a new company, we can begin entity formation in parallel with your immigration process, all handled by one firm.

E-2 Criteria

You must meet all criteria.

National of Treaty Country

​

The investor, either real or corporate person, must be a national of a treaty country to meet this criterion.

Substantial Investment

​

The investment capital and reserves should total a substantial amount, typically $100k or more, to meet this criterion.

Must Place Funds at Risk

​

"At-risk" means that the investment is to be irrevocably committed to meet this criterion.

A Real Operating Enterprise

​

If your business is an operating business offering goods or services, then you meet this criterion. No passive investment. 

Investment Not Marginal

​

​

If you are ROI-positive and generating enough revenue to make a significant economic contribution, like creating jobs, then you meet this criterion.

To Direct Business

​

​

The investor is coming to the U.S. to develop and direct the business. If you own at least 50% of the company or control it through a managerial role, then you meet this criterion.
